Fresh Start - Celery Fields Update 03-02-2018
CELERY FIELDS - Tom Johanning (Primary) and Obie Coomer (Alternate). To all who contributed a proposal to the Fresh Start Initiative: First, a warm thank you for taking time to think seriously about our public lands near the Celery Fields. We have received wonderful proposals, suggestions, feedback, and ideas.
Your efforts first will go to a panel of qualified advisers, then to the Community at Large. We'll then bring those that have the strongest support from our community to the Board of Sarasota County Commissioners.
Your proposal will go forward to the Advisory panel as a numbered folder containing your documents with names and contacts removed. The advisers will meet March 15 to review each for compatibility, community enhancement, economic viability, and feasibility.
Those deemed to meet those qualifications will go forward to our Community Workshop, including a roundtable format that will enable people to learn about each proposal, discuss it, and ultimately offer a weighted vote for each.
Proposals with the highest point values will be brought to the County Commissioners.
The proposals will be submitted to the Commissioners in writing, but we also intend to hold a public meeting with the Board that will allow us to continue the conversation we began with the Commissioners last fall when Fresh Start first approached them with this initiative.

If you have new information, refinements, or images to add to your proposal, you have until March 12 to add them, but best to do so ASAP. You are all invited to the April 10 workshop, and will be invited to the Board meeting when we have a date certain.

Victory to Part 1 of Saving Celery Fields
Reported today, March 22, 2017 in the Herald Tribune, the proposal for the rezoning and approval presented by JMDH Real Estate of Florida, LLC. for a Restaurant Depot/Warehouse has been terminated by the request of the JMDH. This was for the site that is currently housing the Sarasota Fire & Rescue Facility at Apex Road and Palmer Blvd. The Sarasota Commissioners have received and accepted the Termination Letter for the 6.9 acres and the property is now back on the surplus property owned by the county.
Saving Celery Fields
The Laurel Lakes Community HOA Board, in joining with the Bee Ridge HOA Associations, are against the Rezoning and Special Exception Proposal by Mr. James Gabbert of TST Ventures, LLC who is proposing a Rezone and Special Exception for Parcel ID No.'s 0237-05-0001, 0237-05-0002, & 0237-12-0002 to allow a Recycling Facility and Waste Transfer facility on the 16.2 acre currently zoned ILW & OUR located between Porter Road and Apex Road intersecting Palmer Blvd. adjacent to Celery Fields.
DOUBLE WHAMMY for CELERY FIELDS
DOUBLE WHAMMY! Saving the Celery Fields, is still very active. For our residents who have been trying to understand and keep a track of what is going on here is a synopsis. There are two proposals concerning Celery Fields. The first is a rezoning proposal for a 60,000 sq. ft. Wholesale Restaurant Food Depot being presented by JMDH Real Estate of FLorida, LLC. The votes for this proposal is set for the afternoon of April 26, 2017. This proposal has been tabled due to a compliance issues concerning proper disclosure of all of the individuals behind the company including the government of Abu Dhabi. The site which would be located at Apex Road & Palmer Blvd is where the current Temporary Emergency Response Station (Fire Station) is located and opposite of the proposed Apex Dump & Recycling Facility see attached PDF . The second zoning proposal change is across Palmer Blvd. also located on the corner of Apex Road & Palmer BLvd. which has been identified as Apex Dump and Recycling Facility being proposed by TST Ventures, LLC. This is far from over, a second rally concerning this proposal is scheduled for March 11, 2017 check your newspaper and social media for times and location. An article posted in the Herald-Tribune by Elizabeth Djinis (March 2, 2017) has helped clear up some of these questions we have been getting.

The most important one of these letters is to the Chairperson and our District Commissioner, Mr. Paul Caragulio.

CELERY FIELDS COUNTY MEETING - AUGUST 23
On Wednesday, August 23, the Sarasota County Commission will hold a hearing on the rezoning plan: 9:00am, in the Commission Chamber, 1660 Ringling Blvd. Please attend: you can make a statement and experts will testify on our behalf, but a large turnout will make a big impact.

Because of court rulings as well as current Florida legislation, commissioners sit as a quasi-judicial board in land use matters and must behave as judges in making such decisions. As in judicial matters, ex parte communications regarding rezoning, special exceptions, variances and administrative appeals as to individual projects must be based on factual information, which is made part of a public hearing record. The due process rights of all participants include notice, the opportunity to be heard, and the right to be advised of all facts on which the decision makers rely.
For this reason, our commissioners are advised by County legal counsel not to respond to letters, phone calls, emails, or requests for meetings with constituents outside the applicable public hearing.
Some agents for applicants have argued that ex parte lobbying does not violate due process so long as it takes place prior to the actual filing of the application. County legal counsel is aware of no legal authority supporting this argument and has advised the Board against engaging in ex parte communications on quasi-judicial matter either before or after the filing of an application.
Your correspondence is an important part in the public process and will be placed in the public record for all concerned to read. It is important that you know your correspondence will be read by every County Commissioner prior to the public hearing and given its due consideration.
